Title: Real Estate Rep II Location: North Carolina-Charlotte-DE Carolinas-Charlotte,NC (094)The Real Estate Representative II position negotiates appropriate terms in the acquisition or disposition of Transmission Easements and Fee Simple property rights for Duke Energy, its subsidiaries and others to protect the company's real estate assets and utility facilities. The Position also establishes appropriate appraisal values for these transactions and coordinates with internal and external parties, the transfer of these rights utilizing the appropriate real estate and appraisal methods. The Real Estate II Representative also keeps current with best practices, regulations, and laws relating to Real Estate functions and is a resource for others pertaining to these matters. More specifically, the Real Estate Agent II position shall: Utilize communication and negotiating skills to acquire property and property rights required by the Company, its subsidiaries, and others. * Typically is assigned the more complex and politically sensitive property acquisition projects. Assigned projects can range in price from several hundred to several million dollars. * Develops and implements negotiating strategies to facilitate the acquisition process. * Communicates the needs of the Company to landowners, responds to their questions, and works to resolve problems perceived to be created by acquisition projects, e.g., location of Company facilities and their impact on the ability of the owner to sell or develop his property or expand his business. * Negotiates with attorneys representing landowners regarding compensation, document language, and other land issues related to acquisition of easements and fee owned property. * Communicates the real estate valuation process to landowners and negotiates fair and equitable prices for Company property or property rights, acquisitions or sales. Communicates eminent domain procedures to landowners whose property must be acquired through condemnation. * Conducts real estate closings * Coordinates and completes IRS xxxx "Like-Kind Exchanges" of real estate to ensure compliance with Internal Revenue regulations, e.g., trade of parcel(s) of real estate, avoiding or deferring capital gains taxes. Value/Research the most complex properties/property rights to estimate the fair market value as indicated through the use of accepted approaches to real estate valuation. * Individually handles, or participates in, the most complex or politically sensitive valuation projects * Inspects property or properties to be valued and observes the condition of any improvements. * Researches public records, interviews independent real estate professionals and compiles market data for use in the valuation process. * Analyzes market data and applies appropriate adjustment techniques to resolve differences in characteristics of the sales data as compared to the assigned appraisal subject * Prepares written Pre-negotiation Value Estimate prior to negotiating land rights. * Selects and commissions independent fee appraisers, negotiates fees, and reviews their conclusions/reports * In some cases, a licensed Appraiser may be commissioned to provide a property appraisal. * Estimates the "before" and "after" value of properties involved in a transmission or distribution line project to determine the amount of just compensation due the owner(s). * Assists in land feasibility studies for new corridor evaluations and general land purchases. Utilize working knowledge of real estate law and engineering discipline and its application to Company acquisition projects. * Conducts research and takes appropriate action to obtain clear title to property, e.g., interviews all parties who may have an ownership interest; coordinates requests for attorney prepared title opinions; researches zoning records to ensure that properties can be utilized for its intended use by the Company * Resolves defects in land titles so that at the conclusion of property purchases, clear title is acquired, e.g., pays off mortgages, satisfies judgments, pays delinquent taxes, etc. * Coordinates request for zoning amendments with the appropriate city and county agencies and ensures that all Company and support participants are prepared and in attendance for public hearings, etc. * Appears at community association meetings, identifies potential opposition to rezoning, and makes personal contact to win support for rezoning request and influence a favorable public decision. * Interfaces with company Survey and Engineering teams, reviews property plats for accuracy, provides input with respect to problems anticipated with the location of proposed or existing company facilities * Provides testimony, as required, in condemnation trials and public hearings * Negotiates and recommends condemnation settlements and issues drafts for payment * Assists and advises Company personnel and Attorneys in legal proceedings related to eminent domain and assists in preparation and submission of necessary documents for zoning classification changes. * Requests and coordinates voluntary annexation when inclusion of Company facilities into city limits is desirable. * Provide support to Planning and Engineering in the siting of new transmission corridors by considering community impacts, cost evaluations, eminent domain criteria, and political implications of alternate routes. * Evaluate and communicate with Engineering and Planning on rights and restrictions of existing transmission corridors. * Strategically advise customers on Real Estate issues related to the organization. Establish and maintain effective working relationships with internal and external personnel/groups. * Mediates and coordinates the resolution of problems between company departments in the acquisition and disposition of real estate. * Interfaces with vendors, and governmental agencies as needed to acquir
